This Privacy Notice applies to all websites offered by Kenangan Brands Pte. Ltd. and its parent and other affiliated companies (hereafter referred to as “Kenangan Brands”, "we," "us," or "our") except where otherwise noted.

This Privacy Notice is used to inform user, applicant and respondent (the “User”, “you”) concerning our policy in relation with the collection, use, storage, ownership and disclosure of Personal Information.

Please read this Privacy Notice carefully to ensure that you understand how Personal Information is processed by us.

Collection of Personal Information

When the User submits information to our websites, we may collect information concerning the User that may include name (first name and surname), e-mail address, phone number, address, potential capital investment, potential number of stores and potential country for master licensing or franchise business (the “Personal Information”). We may also collect certain additional Personal Information provided that we request it in our websites.

Some of the above Personal Information that we collect is sensitive in nature. We collect this information only with your consent and/or in strict compliance with applicable laws. The Personal Information collected by us shall be stored and used as described in this Privacy Notice.

In circumstances where User provides with Personal Information relating to other individuals (such as Personal Information relating to User’s spouse, family members, friends, or other parties), User represents and warrants that User has obtained such individual’s consent for, and hereby consent on behalf of such individual to, the collection, use, disclosure and processing of his/her Personal Information by us.

Use of Personal Information

We collect the Personal Information and may use the collected Personal Information for the following purposes or other purposes designated by us and permitted by prevailing laws and regulations (the “Purpose of Use”):

1. To assess the User’s qualifications and suitability as a potential franchisee or licensee;

2. Use your contact information to get in touch with you regarding any franchise or licensing inquiry. This may include initial responses to your inquiry, updates on your application status, and any follow-up communication necessary for the franchise or licensing evaluation process;

3. Send User direct or targeted marketing communications, advertisements, surveys, and other information (including information and updates about our franchise or licensing opportunities);

4. Use aggregated and anonymized data from multiple inquiries to analyze trends and patterns in franchise or licensing business;

5. Use your information, including aggregated and anonymized data, for marketing and research purposes to better understand our potential franchisees or licensees and tailor our services accordingly. This may include market research, demographics analysis, and outreach strategies;

6. Monitor usage of the websites, administer, support and improve the performance efficiency, growth, user experience and the functions of the websites;

7. Provide assistance in relation to and to resolve any technical difficulties or operational problems with the websites;

8. Generate statistical information and analytics data for the purpose of testing, research and/or analysis;

9. Offer or provide services from affiliates of Kenangan Brands or third party who work with Kenangan Brands; and

10. Enable Kenangan Brands to comply with obligations under any prevailing laws and regulations, including but not limited to, responding to regulatory enquiries, investigations or directives, complying with regulatory filing, reporting, and licensing requirements, and conducting audit checks, due diligence and investigations. 

Kenangan Brands may create, use, license or disclose Personal Information, provided, however, (i) that all identifiers have been removed such that the data, alone or in combination with other available data, cannot be attributed to or associated with or cannot identify any person, and (ii) that has been combined with similar data such that the original data forms a part of a larger data set.

Disclosure of Personal Information

By submitting the Personal Information in the websites, User hereby agree that Kenangan Brands may share Personal Information between companies in the group of Kenangan Brands, disclose, provide access to or share Personal Information with the services providers, individuals and other parties (including agents, vendors, suppliers, contractors, partners, financial parties (this includes payment processors and facilitators) and other parties providing services to Kenangan Brands or User, performing tasks on behalf of Kenangan Brands, or parties with whom Kenangan Brands has commercial cooperation) for the Purpose of Use or other purposes as permitted by prevailing laws and regulations.

For the avoidance of doubt, Kenangan Brands shall not sell or use Personal Information from the User for commercial purposes other than as stated above.

International Transfer of Personal Information

Subject to the applicable Personal Data Protection Act 2012 (“PDPA”), the User’s Personal Information may be transferred to, stored, or processed outside of Singapore for one or more of the Purpose of Use. The User agrees and gives consent to Kenangan Brands to transfer the Personal Information outside of Singapore to the third party.

When Kenangan Brands transfers User’s Personal Information to the outside of Singapore, Kenangan Brands will comply with its legal and regulatory obligations in relation to User’s Personal Information and putting appropriate safeguards in place to ensure an adequate level of protection for the Personal Information. Kenangan Brands will also ensure that the recipient in the relevant country is obliged to protect User’s Personal Information, including but not limited to, require the recipient to enter into the data transfer agreement and procure the recipient to provide to the Personal Information transferred a standard of protection comparable to the protection under PDPA.

Personal Information Security  

Confidentiality and security of User’s Personal Information is the most important thing for Kenangan Brands. We protect User’s Personal Information using technical, physical, and administrative security steps in order to reduce the risk of loss, misuse, unauthorized access, reveal, or modification of Personal Information.

Even though we use security technologies and processes to help protect User’s Personal Information, there is no internet transmission process or electronic storage method that is 100% (one hundred percent) safe for use or guarantee that such Personal Information will not be intercepted, accessed, disclosed, altered or destroyed by unauthorized third parties, due to factors beyond Kenangan Brands's control. Therefore, we cannot guarantee absolute security.

Retention and Deletion of Personal Information 

The User understands and acknowledges the following:

1. Personal Information collected from the User may be stored, transferred or processed by third party service providers. Kenangan Brands shall use all reasonable efforts to ensure that all such third party service providers to provide a level of protection commensurate with Kenangan Brands's commitments under this Privacy Notice.

2. Kenangan Brands stores User's Personal Information for the period necessary to satisfy the Purpose of Use, or other purposes described in this Privacy Notice or permitted by prevailing laws and regulations unless a longer storage period is required or permitted by law. Once a User's Personal Information is no longer required for the Purpose of Use or other purposes, or Kenangan Brands no longer has a legal or business purpose for storing Personal Information, Kenangan Brands takes steps to delete, destroy, anonymize or prevent access to or use of such Personal Information for any purpose other than compliance with this Privacy Notice, or for the purposes of safety, security, fraud prevention and detection, in accordance with the prevailing laws.

3. User understands that some Personal Information may be stored by other parties including government institutions in certain ways. If Kenangan Brands shares Personal Information with authorized government institutions and/or other institutions that may be appointed by the authorized government or have cooperation with Kenangan Brands, the User agrees and acknowledges that the storage of Personal Information by the relevant institution shall follow the respective data storage policies from the said institutions.

The User can delete Personal Information whenever he/she likes by sending written request to the email address as set out in this Privacy Notice. When the User requests a deletion of Personal Information, Kenangan Brands will make sure that the User’s Personal Information is safely and completely removed from Kenangan Brands’s servers or retained only in anonymized form.

Manage and Update Personal Information

Subject to the prevailing laws and regulations, User may request an update and/or correct Personal Information that is in the possession and control of Kenangan Brands by contacting Kenangan Brands's email address as set out in this Privacy Notice.  

The User may also withdraw his/her consent for the collection, use and/or disclosure and/or request deletion of his/her Personal Information in possession or under control of Kenangan Brands by sending an email to our personal data protection officer at dpo@kopikenangan.com, and we will process such requests in accordance with this Privacy Notice and our obligations under the PDPA and other prevailing regulations. We will inform the User of the likely consequences of withdrawing his/her consent.
